We have filed an emergency application in the Supreme Court to preserve those safeguards. Pennsylvanians' mail ballots must be protected for our country's most important election." Background: Last week, the Pennsylvania Supreme Court allowed voters who failed to follow instructions for casting their mail ballots, such as failing to enclose the ballot in asecrecy envelope, to cast a provisional ballot on Election Day. Pennsylvania law does not allow provisional ballots in these circumstances. The Pennsylvania Supreme Courtcannot rewrite the election laws to fit its members’policy preferences.Requiring ballots to be returned in secrecy envelopes is a critical election integrity safeguard to protect the right to a secret ballot.
