Newsom Signs Bills to Shield California Elections from Interference.
Newsom signed a package of bills Saturday targeting out-of-state military deployments and law enforcement interference with California elections. The measures create new felony offenses and restrict when and how troops or officers may act near ballots and polling places.
- Senate Bill 1354 bars out-of-state National Guard forces from entering California without the governor's approval.
- 4,000-plus National Guard troops and 700 Marines were sent to Los Angeles in June 2025 under Title 10 authority.
- Assembly Bill 282 makes ballot seizure a felony carrying up to four years in prison.
- Riverside County Sheriff Bianco seized more than 650,000 ballots during a 2025 special election.
Why it matters: The legislation tests state limits against federal and interstate military authority ahead of a November election. Two distinct legal frameworks are at issue: Title 10, which grants the president direct command of troops, and Title 32, the hybrid state-federal authority the new law actually restricts.
- A federal judge found the Los Angeles deployment violated the Posse Comitatus Act, an 1878 law barring military enforcement of criminal laws.
- The California Supreme Court has not yet ruled on whether Bianco's ballot seizure was lawful.
How 16 sources split on this story
Where they split: The central dispute is whether the laws protect elections from politically motivated interference or impose partisan restrictions on legitimate law enforcement and election security activity.
Left coverage, 5 sources: The left frames the bills as necessary democratic safeguards against a pattern of federal and local law enforcement intimidation targeting California voters and elections.
Right coverage, 7 sources: The right notes the legislation targets conduct — such as election monitoring and ballot investigations — that the Justice Department and Bianco have defended as legitimate law enforcement activity.
What’s next: The ballot-seizure felony law takes effect immediately; the National Guard ban's enforcement mechanism remains unspecified.
- Newsom is widely mentioned as a potential 2028 Democratic presidential candidate.
- What recourse does California have if another state deploys National Guard troops in defiance of the new law?
- Will federal courts uphold or overturn the ballot-seizure felony provisions if challenged on federal supremacy grounds?
